Refund Policy
The treatment of service fees before and after work starts, and USPTO government fees after filing.
Before work starts
If you cancel an accepted service before any research, attorney review or application preparation begins, the Lexorielle Law service fee is eligible for a full refund. If no service agreement has been accepted and no work has started, you should not be charged a service fee.
After service work begins
If research, consultation, application preparation or other agreed work has started, any unearned portion of the service fee will be refunded. Amounts for work actually performed may be retained only as permitted by the written engagement terms, applicable law and attorney professional obligations. A specific cancellation will be assessed against the actual work completed.
USPTO filing fees
USPTO government filing fees are separate from the attorney/service fee. Once a filing fee has been submitted to the USPTO, it is generally not refundable, including if the application is refused, rejected or abandoned. Any exception is determined under USPTO rules, not by Lexorielle Law. If you pay the USPTO directly, any eligible government-fee refund must be requested through the USPTO. Fees that have not been submitted to the USPTO should not be treated as spent government fees.
Application outcomes
A trademark application is reviewed independently by the USPTO. Denial, delay, an office action or opposition does not by itself establish that a service was not performed or make the government fee refundable. Claims concerning the quality or completion of a paid service will be addressed under the applicable engagement agreement and law.
How to request a refund
Use our enquiry form or call +420 730 446 546. State your name, the email used for the order, the service and the reason for cancellation. Do not include full card numbers. We will review the service status, any completed work and the applicable written terms before confirming an amount and the original payment method where possible.
Applicable rights
Nothing in this policy limits non-waivable consumer rights, applicable payment protections or a lawyer's obligations to return unearned fees. Specific attorney-engagement terms and local rules may require additional or different remedies.
